1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Overseer or Explorer applications (the "Applications"), developed by Drachenspiel Canada ("we," "us," or "Service Provider"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Application.

2. IN-APP PURCHASES & LICENSING

The Application is fundamentally free to use. It offers a one-time In-App Purchase ("IAP") to unlock advanced features.

- Payment unlocks a limited, non-exclusive, non-transferable, revocable license to use those advanced features solely on your personal device.

- This purchase does not constitute a sale of the underlying software code or intellectual property.

3. BILLING AND REFUNDS

All purchases are processed securely through the Google Play Billing System.

- The Service Provider does not collect, view, or store your credit card or financial data.

- Any requests for refunds, payment disputes, or billing errors must be handled directly through Google Play Support according to Google Play’s standard consumer refund policies.

4. LOCAL DATA STORAGE AND LIABILITY LIMITATION

The Application operates entirely locally on your device.

- Audio recordings used for custom notifications are stored strictly on your device's internal storage and are never backed up to a cloud server.

- The Service Provider is not responsible or liable for any loss of data, audio recordings, or app settings resulting from device failure, device damage, operating system updates, or intentional/accidental uninstallation of the Application by the user.

5. PRIVACY POLICY

Your privacy is highly important to us. Your use of the Application is also governed by our Privacy Policy, which outlines how your device's microphone and local storage are utilized. Please review it Here.

6. CHANGES TO THESE TERMS

We reserve the right to update these Terms of Service at any time. Any changes will be reflected by an updated "Last Updated" date at the top of this document. Continued use of the Application after changes are posted constitutes acceptance of those modified terms.

7. GOVERNING LAW

These terms are governed by the laws of Canada, without regard to its conflict of law principles. For users in the EEA/UK, local mandatory consumer protection laws may also apply.
